Welcome to Basedment. These Terms of Service (the "Terms") govern your access to and use of our website at [basedment.com] (the "Site") and your purchase of any products we offer, including apparel, accessories and other merchandise (the "Products"). By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site or purchase our Products. 

1. Acceptance of These Terms These Terms 
apply to every visitor and customer of the Site. We may update or replace any part of these Terms at any time by posting the revised version on the Site. Changes take effect when they are posted. Your continued use of the Site after changes are posted means you accept those changes, so we encourage you to review this page periodically.

2. Eligibility 
By placing an order you confirm that you are at least 18 years of age, or that you are using the Site with the involvement and consent of a parent or guardian, and that you are able to enter into a legally binding contract. You are responsible for ensuring that all information you provide to us is accurate and current.

3. Products, Descriptions and Availability
We make every effort to display our Products and their colours, sizing and details as accurately as possible. We cannot guarantee that your device will display colours accurately, and slight variations in colour, print placement, fabric and finish are normal for manufactured goods and are not regarded as faults. 

All Products are offered subject to availability. Items may be produced in limited quantities or as limited runs, and we may change, limit or discontinue any Product at any time without notice. We reserve the right to limit the quantity of any Product we supply to any customer, household or order.

4. Pricing, Orders and Payment
Prices are shown in Australian dollars unless another currency is selected at checkout, and are subject to change without notice. Where applicable, prices include Australian Goods and Services Tax. For international orders, the currency shown at checkout is converted by our payment provider, and import duties and taxes are addressed in our Shipping Policy.

Your order is an offer to purchase. We reserve the right to accept or decline any order, and to cancel an order after it has been placed, including where a Product is unavailable, where there has been an error in pricing or description, or where we suspect fraudulent or unauthorised activity. If we cancel an order that you have already paid for, we will refund the amount paid. 

Despite our best efforts, a small number of items may be mispriced or contain errors. If we discover an error in the price of an item you have ordered, we will let you know and give you the option of confirming the order at the correct price or cancelling it. 

5. Intellectual Property
The Basedment name, logo, designs, artwork, graphics, text, photography and all other content on the Site are owned by or licensed to us and are protected by copyright, trade mark and other intellectual property laws. Your purchase of a Product gives you ownership of that physical item only. It does not transfer any rights in our designs or branding. 

You may not reproduce, copy, resell, distribute, or create derivative works from our designs, artwork or branding for commercial purposes without our prior written permission. Nothing on the Site should be taken as granting any licence to use our intellectual property except as expressly set out in these Terms. 

6. Authorised Sales and Resale
To be sure you receive a genuine Product, please buy only through the Site or through channels we have officially authorised. We are not responsible for Products purchased through unauthorised resellers, including any issue with authenticity, condition, quality or the handling of your personal information by those resellers. 

7. Accuracy of Information 
We are not responsible if information made available on the Site is not accurate, complete or current. The material on the Site is provided for general information only and should not be relied upon as the sole basis for making decisions. Any reliance on the material on the Site is at your own risk. We reserve the right to modify the contents of the Site at any time, but we have no obligation to update any information. 

8. User Comments, Feedback and Submissions 
If you send us comments, ideas, reviews, feedback or other materials, whether online, by email or otherwise, you agree that we may use, edit, copy, publish and distribute that material without restriction and without any obligation to keep it confidential, to pay compensation, or to respond. 

You agree that your submissions will not infringe any right of a third party, including copyright, trade mark or privacy, and will not contain unlawful, abusive, defamatory or obscene material. You are solely responsible for the content and accuracy of anything you submit.

10. Disclaimer and Limitation of Liability 
Except for any guarantees, rights and remedies that cannot lawfully be excluded, the Site and our Products are provided on an "as is" and "as available" basis. We do not warrant that your use of the Site will be uninterrupted, timely, secure or free of errors. 

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to replacing the Product, supplying an equivalent Product, or paying the cost of doing so. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss arising from your use of the Site or our Products.

You agree to indemnify and hold harmless Basedment and its officers, employees, contractors and service providers from any claim or demand, including reasonable legal costs, arising out of your breach of these Terms, your misuse of the Site or Products, or your breach of any law or the rights of a third party. 

12. Changes to the Service and Prices Prices 
for our Products are subject to change without notice. We reserve the right to modify or discontinue the Site or any Product or service at any time. We will not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Site or any Product.

13. Governing Law 
These Terms are governed by the laws of New South Wales, Australia. You and Basedment submit to the non exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.
