OVERVIEW

This online store is operated by Basedment. Throughout the site, the terms “we”, “us” and “our” refer to Basedment. By visiting our site or purchasing from us, you agree to these Terms of Service, our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use the site.

1. ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your place of residence, or have permission from a parent or guardian, to use this site. You are responsible for providing accurate, current and complete information and for keeping any account credentials secure.

2. PRODUCTS

We aim to display product descriptions, colours, sizing and images as accurately as possible. Actual colours and appearance may vary by device and production process. Many items are printed to order. Product availability, designs, specifications and prices may change without notice.

3. ORDERS

Submitting an order is an offer to purchase. An order is accepted when we send confirmation that it has been accepted or dispatched. We may refuse or cancel an order where reasonably necessary, including for suspected fraud, payment issues, pricing errors, stock or production problems, or restrictions affecting the delivery destination. If we cancel after payment, we will refund the amount paid for the cancelled item.

Review your order, size and delivery address carefully before submitting it. Because production may begin quickly, changes or cancellations cannot be guaranteed after an order is placed.

4. PRICES AND PAYMENT

Prices are shown in the currency selected or displayed on the site. Shipping charges, applicable taxes, duties and other charges are shown at checkout where available. International customers may be responsible for import duties, taxes or customs charges not collected at checkout. You confirm that you are authorised to use the payment method supplied.

5. PRODUCTION, SHIPPING AND DELIVERY

Products may be fulfilled by third-party production partners in different locations. Items in one order may arrive in separate packages. Processing and delivery times are estimates and are not guaranteed. Delays may occur because of carriers, customs, peak periods or events outside our reasonable control. 6. RETURNS, REFUNDS AND CONSUMER RIGHTS

Returns, replacements and refunds are handled under our Refund Policy. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. Where goods fail to meet a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy as provided by law.

7. INTELLECTUAL PROPERTY

Unless otherwise stated, the content of this site—including the Basedment name, logos, designs, text, graphics, images, audio and video—is owned by or licensed to Basedment and is protected by applicable intellectual property laws. You may use the site for personal, non-commercial purposes only. You must not reproduce, distribute, modify, publish, sell or exploit site content without prior written permission, except as permitted by law.

8. ACCEPTABLE USE

You must not use the site for unlawful, fraudulent, harmful or abusive purposes; infringe another person’s rights; introduce malicious code; attempt to interfere with the site’s security or operation; scrape or collect information without permission; impersonate another person; or submit false or misleading information.

9. THIRD-PARTY SERVICES AND LINKS

Our store is hosted by Shopify and may use third-party services, payment providers, production partners and carriers. Third-party links and services are governed by their own terms and policies. To the extent permitted by law, we are not responsible for third-party websites or services that we do not control.

10. PRIVACY

Personal information is handled in accordance with our Privacy Policy. Information may be processed by Shopify and other service providers needed to operate the store, process payments, produce products and deliver orders.

11. ERRORS AND AVAILABILITY

We may correct typographical errors, inaccurate descriptions, pricing errors, promotions, availability information or shipping estimates at any time. If an error materially affects an order that has already been placed, we will contact you and provide an appropriate option, which may include cancellation and a refund.

12. DISCLAIMERS AND LIABILITY

We do not guarantee that the site will always be available, uninterrupted, secure or error-free. To the maximum extent permitted by law, the site and its content are provided on an “as available” basis. We are not liable for indirect or consequential loss arising from use of the site or products where such liability can lawfully be excluded. These limitations do not apply to liability or consumer rights that cannot be excluded under applicable law.

13. INDEMNITY

To the extent permitted by law, you agree to indemnify Basedment against loss arising from your unlawful use of the site, your infringement of another person’s rights, or your material breach of these Terms.

14. SEVERABILITY AND WAIVER

If any part of these Terms is found unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver of that provision.

15. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. Courts with jurisdiction in New South Wales may hear disputes, subject to any mandatory rights you have under the laws of your place of residence.

16. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on this page. Changes apply from the date they are published, subject to applicable law.
